Terms and Conditions

  

Delivery Times

1. When can I expect to receive the product? 

While delivery time may be variable based on the nature of the assignment and/or product, the client can expect to receive services/products they paid for within 15 days of Wyktoria Taschler receiving invoice payment. Additional stipulations and expectations will be discussed during assignment consultation so that no surprises arise upon completion. Physical products and/or mailed materials will be shipped within the 15 day time-frame, but are subject to the delivery dates of the selected postal service. 


2. What if my product arrives late?

As client needs are top priority, I will undertake the responsibilities under my control to ensure that products are delivered within the stated time frame. Upon the instance that this is not performed, I implore the client to contact me for further discussion. For late delivery caused by my incompetence, I will include additional good and services than provided in the assignment agreement, as well as adequate compensation for any repercussions the client may face for a late delivery. In the event that products are delivered late due to circumstances outside of my control (natural disaster, act of God, etc.), then I prioritize delivery the services within no more than 30 days after the initial agreed upon delivery date. As these instances of late delivery are circumstantial, a discussion between the client and I will be had around these parameters to come to a consensus. 


3. Can you mail it to me?

Yes! And we will cover shipping and handling costs as a courtesy. For physical copies of digital files, there is a choice between hard drive and USB drive. The client will pay the cost of the hardware. Physical prints will be mailed with environmentally friendly packaging protection. 


Customer Contacts

1. How will customers know when their order is ready?

When the customer is notified that an invoice has been sent to the appropriate parties, they will also be notified that this indicates that their order is ready to be delivered upon payment. 


2. What can my customers expect in the way of return phone calls?

All missed phone calls will be returned within one business day. If a prolonged period occurs where phone calls cannot be returned, a message will be prerecorded into an answering machine directing the caller to leave their message and to reach out via email. 


Payment Plans

1. How much do I have to pay and when do I have to pay it?

All incurred fixed expenses for elements required to operate the shoot (model costs, wardrobe, props, equipment rental) shall be paid in full up-front. All other variable and licensing expenses (usage, transportation costs, printing, etc.) shall be paid within 90 days of the client receiving the invoice. 


2. Are deposits refundable?

All refunds will be subject to the stipulations of cancellation/reshooting in terms of if the project money was already spent. Due to paying fixed expenses upfront, some aspects may not be refundable. 


Quality Assurance

1. What if I don't like the photography, will you do a re-shoot?

It is the responsibility of the client to provide representation to evaluate and asses the quality of the photo shoot. Extensive pre-planning, drafting, and exchange of ideas prior to the photo shoot is intended to eliminate the need for a re-shoot based on client satisfaction. Due to the nature of financing a shoot, it is imperative that the client or their representation communicate all dissatisfaction and necessary changes during the assignment. If the client fails to do so, a re-shoot may be done at their expense. 


Safety Assurance

1. How safe are my products that I'm leaving with you to photograph?

All equipment/product/items provided by the client are covered by insurance. Client holds responsibility and assumes risks for loss/damage of products during the assignment, including transportation of the equipment.


Legal Issues

1. What if I want to copy this?

Permissions to copy the product (including scanning, reproduction, printing, digital duplication) will be outlined in the licensing agreement. Unless usage rights have been granted to the client, copying of the product is prohibited and is subject to violation of copyright laws. 


2. Can I have the negatives?

As standard, the negatives (or RAW files for digital) will not be available for client purchase unless the client agrees to purchase the entire copyright for the assignment. Purchasing a usage license is not the same as purchasing the copyright.

 

Refunds & Exchanges

1. As most transactions are service/license based, exchanges are typically not offered. In the event that a client would like different print sizes, a free compensation of      prints up to 5 inches larger or smaller in each dimension will be provided free of charge. Frames and other display goods may be exchanged for those of equal value, as I am able to repurpose these materials. 


2. In the event of delivery of damaged/malfunctioning goods, I will replace the affected items at no cost to the client up to a monetary value of $300. 


3. All refunds will be subject to the stipulations of cancellation/reshooting on the basis of if the project money was already spent. Due to paying fixed expenses upfront, some aspects may not be refundable. 


Changing an Order

Once an assignment confirmation has been created and signed, all changes to an order must be conducted through a change order form. Changes made to the order/delivery of physical products are allowed a week prior to manufacturing of the goods taking that the client agrees to pay standard rates of desired changes (client will be notified of this date for their awareness.) Additional fees and delivery delays may incur due to the time-frame of the change. 


Image Preview System

Clients will be provided access to a Zenfolio link to digitally preview all images. 


Copying and Usage

I, Wyktoria Taschler, retain all copyright to my images and photographic assets for each assignment. In order for a client to use their images, a usage license and agreement must be purchased prior to use. Details, responsibilities, expectations, and limitations will be outlined in the usage license dependent on client's need and financing. Violations to this term are considered violation of copyright law and subject to legal action.


Late Delivery of Product or Service

Re-shoots

1. It is the responsibility of the client to provide representation to evaluate and asses the quality of the photo-shoot. Extensive pre-planning, drafting, and exchange of ideas prior to the photo-shoot is intended to eliminate the need for a re-shoot based on client satisfaction. Due to the nature of financing a shoot, it is imperative that the client or their representation communicate all      dissatisfaction and necessary changes during the assignment. If the client fails to do so, a re-shoot may be done at their expense with a fee charge of 100%. 


2. In the event that a re-shoot and/or rescheduling is required due to but not limited to natural disaster, acts of God, war, terrorism, civil disturbance, or fault of a      third party, the client will pay all expenses (except those covered by insurance) and Wyktoria Taschler will charge no extra fee.

 

Cancellation of Jobs Where Deposit Has Been Made

All refunds will be subject to the stipulations of cancellation/re-shooting in terms of if the project money was already spent. Due to paying fixed expenses upfront, some aspects may not be refundable. For all pre-paid expenses that are possible to refund, monetary compensation will be provided. There will be no refund of the creative fee if the cancellation of the job is due to client reasons. 


Estimates that are Over or Under the Actual Bill

During each assignment, each expense will be meticulously documented. Budgets and maximum allowances shall be set between the photographer and the client to prevent estimates that are under the actual bill on the invoice. In the event that the estimate is under the actual bill, the client will be provided a choice between a.) additional services/physical products provided to the assignment package and equal monetary cost to the difference, or b.) donate all unused funds to The Amalgamation of Wyktoria Taschler's Robin Hood Fund (which helps lower the cost of assignment work for local businesses and creatives in the Spokane area.) 


Liability for Property Left on Premises

Covered by insurance for up to 15 days after completion of assignment or otherwise communicated and approved by Wyktoria Taschler. After this time period, Wyktoria Taschler will not be held liable for any loss/damage to the property on premises. If client fails to remove their property within 45 days after completion of assignment, it will be considered abandoned.
